Terms of Sales
1. Preamble
These general conditions of sale (hereinafter "CGV") govern the contractual relations between Model Kit Shop (Denis Gomez), whose head office is located at Fontenilles 43 rue des lagestroemias 31470, registered in the Trade and Companies Register under the number 79245028000021 (hereinafter "the Company"), and any natural or legal person (hereinafter "the Customer") wishing to make a purchase via the Company's website or any other sales channel (hereinafter "the Customer") -after “the Site”).
2. Acceptance of the General Conditions of Sale
By placing an order on the Site, the Customer accepts these General Terms and Conditions without reservation. These General Terms and Conditions take precedence over any other document emanating from the Customer, unless formally and expressly waived by the Company.
3. Products and Services
The essential characteristics of the products and services are presented on the Site. The Customer is required to read these characteristics before placing an order. The photographs and illustrations are not contractual and cannot engage the responsibility of the Company.
4. Orders
Any order placed on the Site constitutes a firm and definitive commitment on the part of the Customer. The Company reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
5. Price
The prices of products and services are indicated in euros, all taxes included (TTC), unless otherwise indicated. The Company reserves the right to modify its prices at any time, but the products and services will be invoiced on the basis of the prices in effect at the time the order is validated by the Customer.
6. Payment
Payment for purchases is made by credit card, PayPal, bank transfer or any other payment method accepted by the Company. Payment is due upon ordering. In the event of non-payment, the order will be automatically canceled.
7. Delivery
Deliveries are made to the address indicated by the Customer when ordering. Delivery times are indicative. The Company cannot be held responsible for the consequences due to a delay in delivery or loss of packages caused by a third party or by the Customer.
8. Withdrawal and Returns
In accordance with current legislation, the Customer has a period of fourteen (14) days from receipt of the products to exercise his right of withdrawal without having to provide reasons or pay penalties. Products must be returned in their original condition and complete. Return costs are the responsibility of the Customer.
9. Guarantees
The products benefit from the legal guarantee of conformity and the guarantee against hidden defects. In the event of non-compliance or hidden defect, the Customer must notify the Company in writing and return the product concerned for exchange or refund.
10. Liability
The Company cannot be held responsible for damages resulting from improper use of the products or services. The Company's liability is limited to the amount of the order placed by the Customer.
11. Personal Data
The information collected by the Company during a Customer order is necessary for the management of the order and the improvement of the services. In accordance with the “Informatique et Libertés” law, the Customer has the right to access, rectify and delete data concerning him.
12. Intellectual Property
All elements of the Site are and remain the intellectual and exclusive property of the Company. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the Site without express authorization.
13. Applicable Law and Disputes
These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the French courts will have jurisdiction to settle the dispute.
14. Modification of the General Conditions of Sale
The Company reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the date of the order placed by the Customer.
