General Conditions of Sale
1. Preamble
These general terms and conditions of sale (hereinafter "CGV") govern the contractual relations between Model Kit Shop (Denis Gomez), whose head office is located in Fontenilles 43 rue des lagestroemias 31470, registered in the Register of Trade and Companies under number 79245028000021 (hereinafter "Entreprise"), and any natural or legal person (hereinafter "the Customer") wishing to make a purchase via the Website of the Company or any other person.
2. Acceptance of the General Conditions of Sale
By placing an order on the Site, the Customer accepts without reservation these CGVs. These VGCs prevalent on any other document from the Customer, unless expressly and expressly derogated from the Company.
3. Products and Services
The essential characteristics of products and services are presented on the Site. The Customer is required to be aware of these characteristics prior to any ordering. Photographs and illustrations are not contractual and cannot be responsible for the Company.
4. Commands
Any order placed on the Site constitutes a firm and definitive commitment from the Customer. The Company reserves the right to cancel or refuse any order of a Customer with whom a dispute concerning the payment of an earlier order exists.
5. Price
Prices of goods and services are indicated in euros, all taxes included (TTC), unless otherwise specified. The Company reserves the right to change its prices at any time, but the products and services will be charged on the basis of the rates in effect at the time of the Customer's validation of the order.
6. Payment
Payment of purchases is made by credit card, PayPal, bank transfer or any other payment method accepted by the Company. Payment is payable to the order. In case of non-payment, the order will be cancelled straight.
7. Delivery
The deliveries are made to the address indicated by the Customer during the order. Delivery times are indicative. The Company shall not be held liable for the consequences of a delay in delivery or a loss of parcel caused by a third party or by the Customer.
8. Revocation and Returns
In accordance with current legislation, the Customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to justify reasons or to pay penalties. Products must be returned to their original and complete state. Return costs are borne by the Customer.
9. Guarantees
The products benefit from the legal guarantee of compliance and guarantee against hidden defects. In case of non-compliance or hidden defects, the Customer must notify the Company in writing and return the product concerned for exchange or refund.
10. Accountability
The Company cannot be held liable for damages resulting from misuse of products or services. The responsibility of the Company is limited to the amount of the order placed by the Customer.
11. Personal data
The information collected by the Company during an order by the Customer is necessary for order management and service improvement. In accordance with the law "Informatique et Libertés", the Customer has a right of access, rectification and deletion of the data concerning him.
12. Intellectual property
All elements of the Site are and remain the intellectual and exclusive property of the Company. No person is authorized to reproduce, operate, rebroadcast, or use, in any capacity, even in part, elements of the Site without express authorization.
13. Applicable and Litigation Law
These CGVs are subject to French law. In the event of a dispute, a friendly solution will be sought before any legal action. Otherwise, the French courts will be competent to resolve the dispute.
14. Amendments to the General Conditions of Sale
The Company reserves the right to amend these VTCs at any time. The applicable GTCs are those in effect on the date of order placed by the Customer.
